Visa to work in the US: three options that Venezuelans can access

Venezuelans continue to look for ways to emigrate to the United States, so some have chosen to look for irregular routes to reach North American territory. The immigration lawyer Javier Montano He explained that there are visa options that many Venezuelans can apply for.

During an Instagram Live with El Pitazo, el abogado afirmó que es una "urban legend" to think that the Venezuelan only has the option of entering the United States as a tourist and requesting asylum. He explained that there are visas, such as investor visas and extraordinary abilities, with which they can immigrate regularly to the country.

The lawyer recalled the importance of taking the time to make a legal strategy before entering the United States and expressed that each visa that this country grants has an intention.

«It is an urban legend to think that Venezuelans only have the option of entering as a tourist and applying for asylum. In my experience, we have noticed that Venezuelans do not apply for many immigration benefits for which they would qualify," explains Montano.

Investor visa

«Although it is recommended that it be an investment of $100,000, it is not necessary. In theory It can be a $50,000 or $10,000 business. In my practice I recommend 100,000 because this way the immigration department can be convinced that it is a viable business and that it will give you enough to live in the United States," said the lawyer.

Required documents include evidence of the applicant's nationality, ownership documents for the E-1 Visa or evidence of investment for the E-2 Visa, as well as additional documents supporting the eligibility of the applicant and the company.

Talent visa

The O visa, known as the extraordinary talent or ability visa, is a type of visa aimed at individuals with an exceptional level of ability in various fields.

To qualify, applicants must demonstrate their outstanding talent through awards, recognitions, publications or other relevant achievements in their field.

«There are many Venezuelans who have a term of distinction. Many people think that they would only qualify if you have a gold record, if you are a singer, an artist or a chef. They are open to almost all professions that exist. Many times, because we are confused by talent, we think that the person has to be a super man or a super woman. The term requires only distinction. With that visa many people can enter the United States and they do not know it or think that they do not qualify,” says the lawyer.

Employment Certification Visa

The Employment Certification Visa is one that requires the employer to demonstrate that it has made active recruiting efforts and has been unable to find a qualified worker in the United States for the position in question. Once the labor certification is obtained, The employer can proceed with the immigrant visa application for the foreign workerro.

«A company in the United States requires a person who has your profile and if no one applies for that job, if there is no American resident who qualifies for that job and who wants to do it, then you are certified that you are not taking the job away from a person. American. It is a certification that you are not affecting the labor market for an American. And you can use that labor certification to apply for a residence,” explains the lawyer.
