Hay un nivel de crueldad y arbitrariedad sin precedentes. Lo que estamos viviendo parece sacado de un mal episodio de\u00a0<em>La dimensi\u00f3n desconocida<\/em>.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfPor qu\u00e9 hablas de crueldad y arbitrariedad?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: Porque estamos viendo a una administraci\u00f3n que interpreta las leyes migratorias a su conveniencia, ignorando principios b\u00e1sicos del debido proceso. Por ejemplo, agentes migratorios detienen personas simplemente por hablar espa\u00f1ol o estar en zonas asociadas con comunidades latinas, sin causa razonable.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfQu\u00e9 puede hacer una persona si agentes migratorios la detienen en la calle o mientras maneja?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: Es fundamental no resistirse ni enfrentar f\u00edsicamente a los agentes. Legalmente, un carro es una extensi\u00f3n de tu propiedad, y si no hay causa razonable, no tienes por qu\u00e9 abrirlo. Pero siempre hay que actuar con prudencia para no empeorar la situaci\u00f3n legal. Y muy importante: cada caso es distinto. Algunos deben cooperar, otros deben guardar silencio y contactar a un abogado.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfY si los agentes llegan a tu casa?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: No pueden entrar sin una orden de cateo firmada por un juez, no por ICE. Es tu derecho por vivir en EE.UU. Y por eso hay que estar preparado con anticipaci\u00f3n, tener un plan legal, no esperar a que te toquen la puerta.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: Algunos abogados dicen que si tienes una cita migratoria, debes presentarte. \u00bfT\u00fa qu\u00e9 opinas?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: Legalmente, los abogados debemos aconsejar a nuestros clientes que acudan si est\u00e1n obligados por ley. Pero tambi\u00e9n es nuestra responsabilidad explicarles los riesgos, como posibles detenciones. Al final, el cliente decide.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfExisten alternativas virtuales para esas citas?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: En algunos casos, como audiencias ante la Corte de Inmigraci\u00f3n, s\u00ed se puede usar Webex. Pero las citas con ICE \u2014las m\u00e1s peligrosas\u2014 no permiten esa opci\u00f3n. All\u00ed hay que ir en persona.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: Quiero hablar del caso de Venezuela. \u00bfLa detenci\u00f3n de Maduro afecta a los venezolanos en EE.UU.?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: Es absurdo pensar que por arrestar a un dictador se acaba un sistema represivo de m\u00e1s de dos d\u00e9cadas. De hecho, podr\u00eda empeorar la situaci\u00f3n interna, y eso puede fortalecer solicitudes de asilo de venezolanos.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfY los cubanos? \u00bfPor qu\u00e9 ahora tambi\u00e9n est\u00e1n siendo deportados?<\/p><p style=\"font-weight: 400;\"><strong>Montano<\/strong>: Se elimin\u00f3 el beneficio de \u201cpies secos, pies mojados\u201d. Ahora los cubanos son tratados como cualquier otro inmigrante. Ya no reciben parol autom\u00e1tico, deben solicitar asilo, y muchos de esos casos est\u00e1n siendo litigados. Hay incluso cubanos que podr\u00edan ser deportados a terceros pa\u00edses como Ecuador o Uganda. Es una traici\u00f3n a una comunidad que ha apoyado fuertemente a este pa\u00eds.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfQu\u00e9 pasa con los 75 pa\u00edses a los que EE.UU. bloque\u00f3 las visas?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: Esa lista afecta visas de inmigrante. Pero se est\u00e1n sentando bases para extender esas restricciones tambi\u00e9n a visas de no inmigrante, como turistas o estudiantes. Usan el argumento de la \u00abcarga p\u00fablica\u00bb, alegando que ciudadanos de esos pa\u00edses podr\u00edan depender de ayudas del gobierno.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfY para quienes quieren venir al Mundial de 2026?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: Personas de ciertos pa\u00edses tendr\u00e1n que pagar fianzas de entre $5,000 y $15,000 por persona para obtener visas de turismo. Si una familia quiere venir, pueden estar hablando de $20,000 o m\u00e1s, sin claridad sobre c\u00f3mo o cu\u00e1ndo se les devolver\u00eda ese dinero.<\/p><p style=\"font-weight: 400;\"><strong>JR<\/strong>: \u00bfCrees que 2026 ser\u00e1 a\u00fan m\u00e1s dif\u00edcil para los inmigrantes?<\/p><p style=\"font-weight: 400;\"><strong>JM<\/strong>: Absolutamente. Ya hemos visto m\u00e1s de 600,000 deportaciones. Est\u00e1n apuntando a quienes son m\u00e1s f\u00e1ciles de localizar, pero pronto podr\u00edan entrar en espacios p\u00fablicos o privados de forma m\u00e1s agresiva.
