Para ello, el gobierno exige que el empleador demuestre que:<\/p><p>No hay trabajadores estadounidenses disponibles, dispuestos y calificados para ocupar el puesto ofrecido.<\/p><p>La contrataci\u00f3n del trabajador extranjero no afectar\u00e1 negativamente los salarios ni las condiciones laborales de los trabajadores en Estados Unidos.<\/p><p><b>\u00bfC\u00f3mo funciona el proceso?<\/b><\/p><p>En t\u00e9rminos generales, PERM incluye estos pasos:<\/p><p>Determinar el salario que corresponde al puesto seg\u00fan el \u00e1rea y el tipo de trabajo (salario prevaleciente).<\/p><p>Realizar un proceso de reclutamiento y anuncios para buscar candidatos estadounidenses.<\/p><p>Presentar la solicitud PERM ante el Departamento de Trabajo si no se encuentra un candidato calificado y disponible.<\/p><p>Esperar la decisi\u00f3n del DOL, que puede aprobar, negar o solicitar revisi\u00f3n adicional.<\/p><p><b>\u00bfQu\u00e9 ocurre despu\u00e9s de la aprobaci\u00f3n?<\/b><\/p><p>Si PERM es aprobado, el empleador puede presentar una petici\u00f3n migratoria ante USCIS (Formulario I-140). Luego, el trabajador puede continuar el proceso para solicitar la residencia permanente, dependiendo de su categor\u00eda, fecha de prioridad y disponibilidad de visa.<\/p><p><b>Punto clave<\/b><\/p><p>La certificaci\u00f3n PERM no otorga la residencia por s\u00ed sola.
